Term and conditions for entry into the Tell Us Your Stories competition

Promoter Details

1. The Promoter of this competition for Fabris Lane Sunglasses is Fabris Lane Ltd of 1 Lion Park Avenue, Chessington, Surrey, KT9 1ST.

Conditions of entry

2. The competition is only open to UK residents aged 16 years or over, excluding employees of Fabris Lane, their friends or family, or anyone connected with this promotion or the product given away as the prize.
3. By entering the competition, you are deemed to accept and be bound by these terms and conditions. How to enter
4. Opening date for entries is 27 July 2009. Closing date is tbc.
5. The competition will be available at www.fabrislane.co.uk.
6. The competition is free to enter. To enter you will need to fully and legibly complete the entry form which will request details of your name, email address.
7. You will also need to write your story into the appropriate field on the entry form..
8. Once you have completed this process and submitted your entry you will be entered into our competition.
9. Winning will then be uploaded to the Fabris Land website at www.fabrislane.co.uk/me-and-my.html.
10. The winners of the competition will be the people who (in the eyes of our judges) have told the most entertaining stories.
11. Any material and information submitted by an entrant must be personal to that entrant and relate specifically to them (ie entrants must only submit their own stories and not that of a third party).
12. The Promoter is not responsible, and shall not be liable, for any problems related to any telephone network/lines, computer on-line systems or equipment, software failure of any email or failure of an entry to be uploaded on account of technical problems or traffic congestion on the Internet, telephone lines or www.fabrislane.com/www.fabrislane.co.uk, or any combination thereof, including but not limited to any injury or damage to an entrant’s or any other person’s computer related to or resulting from participation in this promotion.
13. Only one entry per person. No entries will be accepted by agents, in bulk or from third parties.

Use of material submitted by entrants to the promotion

14. In return for entry into the competition upon submission of a Story, the entrant automatically grants to the Promoter a non-exclusive, irrevocable, royalty-free, worldwide, sub-licensable licence for the full period of copyright to use, electronically reproduce, distribute, alter and adapt any information or material submitted as part of this competition (including, without limitation, the Story) in any and all media (including on www.fabrislane.com and www.fabrislane.co.uk).
15. The Promoter reserves the right, but not the obligation, to publish on www.fabrislane.com/www.fabrislane.co.uk any Stories received as part of the competition. Entrants acknowledge that the nature of the internet means that such Stories will be available to be uploaded and viewed worldwide.
16. Entrants agree to waive any moral rights they may have in the Story or any other material submitted as part of the promotion.
17. By entering this promotion and submitting any material (including, without limitation, the Story) each entrant warrants to the Promoter that:
a. they own any material submitted as part of the promotion and that the Promoter is free and able to use the material in accordance with and in the manner set out in these terms and conditions;
b. the material does not infringe any third party's intellectual property rights, other proprietary rights or rights of privacy;
c. the material does not violate any applicable law or regulation (including any laws regarding anti-discrimination or false advertising);
d. the material is not defamatory, trade libellous, unlawfully threatening or unlawfully harassing;
e. the material is not obscene or pornographic.
18. The Promoter reserves the right but not the obligation to screen or monitor entries to this competition and to refuse to accept or take down and remove from www.fabrislane.com/www.fabrislane.co.uk any material submitted as part of this competition (including in the event that the Promoter believes the material is in breach of point 17 above).

Winners and Prizes

19. A panel of judges appointed by the Promoter will pick the winners of the competition. The names of the judges are available on request to the Promoter at the address above.
20. The judges will choose the winners from all qualifying entries received. The selected winners will be notified by email within 14 days of being selected and will be invited to accept their prize by responding with any details and within the time frame as specified in the winners notification email. Failure to claim the prize in the manner and time frame specified in the email will make any claim invalid. The judges will then chose another winner (again judged on the criteria stated at point 10 above) from the remaining entries and this winner will be contacted by email as previously stated.
21. Each winner will be able to choose 1 PAIR OF ANY FABRIS LANE SUNGLASSES FREE OF CHARGE from the Spring/Summer 2009 collection as available via www.fabrislane.com/www.fabrislane.co.uk.
22. Prizes will be sent within 30 days of the winners validly responding to the notification email (see point 20).
23. Entrants agree the Promoter may use the names and addresses of winners, their Story and any media submitted by them in relation to this promotion for publicity purposes.
24. A list of winner’s names is available by sending a SAE marked ‘FABRIS LANE ‘Tell us your stories’ Competition’ to the Promoter at the address above from 27th July 2009.
25. The Promoter reserves the right in its reasonable discretion to substitute the prizes for a prize of equal or greater value. No cash or alternative prizes are available.

General

26. To the fullest extent permitted by law, the Promoter hereby excludes all warranties, representations, covenants and liability (whether express or implied) relating to this promotion and the prize. Nothing however shall exclude the Promoter’s liability for
(i) death or personal injury as a result of its negligence;
(ii) fraud or fraudulent misrepresentation; or
(iii) any liability that cannot be limited or excluded by law.
27. Unless you have indicated otherwise, the Promoter will only use your personal details submitted as part of this promotion to administer the promotion. This will include use of your Postcard from Glastonbury as set out in these terms and conditions.
28. In the event of any dispute regarding this promotion, the decision of the judges and the Promoter shall be binding and final and no correspondence or discussion shall be entered into.
29. The Promoter reserves the right to disqualify any entrant whose conduct is contrary to the spirit of these terms and conditions. In the event of circumstances beyond its reasonable control, the Promoter reserves the right to withdraw, amend or cancel this promotion.
30. The laws of England and Wales shall govern these terms and conditions and this promotion and any dispute shall be subject to the jurisdiction of the English court.
